Terms of Service - InfinLume

1. Acceptance of Terms

Welcome to InfinLume. These Terms of Service ("Terms") govern your access to and use of the InfinLume mobile application, websites, and related services provided by InfinLume ("we," "us," or "our") (collectively, the "Services").

By downloading, installing, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Services.

2. Description of Service

InfinLume is an AI-powered language learning service that provides:

Personalized grammar lessons adapted to your skill level
Visual knowledge mapping to track your learning progress
Interactive exercises and quizzes
Flashcards, reading, listening, and supported audio features
Speaking practice that can record a temporary voice clip, transcribe it, and provide automated feedback
Website and in-app diagnostics that help estimate level and recommend learning next steps
Progress tracking and learning analytics
Optional paid access to additional features through InfinLume Plus

We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time without prior notice.

3. Account Registration

To use certain features of the Services, you must create an account using Google Sign-In or Apple Sign-In. You agree to:

Provide accurate and complete information
Maintain the security of your account credentials
Notify us immediately of any unauthorized access to your account
Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. User Conduct

When using InfinLume, you agree NOT to:

Use the Services for any unlawful purpose or in violation of any applicable laws
Attempt to gain unauthorized access to the Services, other accounts, or our systems
Interfere with or disrupt the Services' functionality or servers
Reverse engineer, decompile, or disassemble any part of the Services
Copy, modify, or distribute the Services' content without authorization
Use automated systems or software to extract data from the Services
Impersonate any person or entity or misrepresent your affiliation
Upload or transmit viruses or malicious code
Harass, abuse, or harm other users

5. Intellectual Property Rights

InfinLume owns its original software, design, branding, and original educational content, except where a page identifies third-party material, user content, or another rights holder. Third-party trademarks and materials remain the property of their respective owners; their appearance does not transfer ownership to InfinLume or imply endorsement.

Unofficial recalled or community-circulated exam questions may be presented as independent practice material. They are not represented as official, verbatim, guaranteed to recur, or endorsed by a test provider. If you believe material available through the Services infringes your rights, contact team@infinlume.com with enough information for us to investigate.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes in accordance with these Terms.

You may not:

Reproduce, distribute, or publicly display any content from the Services
Create derivative works based on the Services or their content
Use our trademarks or branding without written permission

6. User Content

You retain ownership of content you submit or generate through the Services, including learning answers, preferences, feedback, voice clips, and transcripts. You grant InfinLume a limited, non-exclusive, worldwide, royalty-free license to receive, transmit, process, store, and display that content only as reasonably necessary to operate, secure, support, troubleshoot, and improve the Services as described in our Privacy Policy.

When you choose a speaking feature, a voice clip may be transmitted to speech-recognition providers for transcription. We do not intentionally retain raw voice clips in InfinLume databases or storage buckets, and we do not use recordings to train AI, clone a voice, create a voiceprint, or identify a speaker. We may retain transcripts, scores, and technical metrics to provide feedback and diagnose recognition or scoring errors. Some open-ended speaking feedback may send the transcript—but not the raw recording—to a text-model provider. Provider-specific processing and retention are explained in the Voice & AI section of our Privacy Policy.

We do not sell User Content. We configure Deepgram transcription requests to opt out of its Model Improvement Partnership, and Soniox states that it does not use customer content to train or improve its models. These provider commitments and their limits are linked in our Privacy Policy.

You represent that you have all necessary rights to submit any content and that your content does not violate any third-party rights or applicable laws.

7. Subscriptions and Payments

Some features of InfinLume are offered as paid, auto-renewing subscriptions purchased through Apple App Store or Google Play Store billing. The current paid subscription tier offered in the submitted mobile app is InfinLume Plus.

InfinLume Plus may unlock features such as Knowledge Hive access for every CEFR level, unlimited daily practice quizzes, full audio for supported library books, and other Plus features described in the app before purchase. Feature availability may vary by platform, region, app version, language, content catalog, or technical availability.

Plus may be offered in monthly or annual subscription periods. The displayed subscription title, price, billing period, and any trial or introductory terms are shown before purchase confirmation.
Payment is charged to your Apple ID or Google Play account at confirmation of purchase.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
Your account may be charged for renewal within 24 hours before the current period ends.
You can manage or cancel your subscription in your device store settings:
- iOS: Settings > Apple ID > Subscriptions, or apps.apple.com/account/subscriptions
- Android: Google Play > Payments & subscriptions > Subscriptions, or play.google.com/store/account/subscriptions
Deleting your InfinLume account does not automatically cancel an active store subscription; cancellation must be completed in the store account where you subscribed.
A Restore Purchases flow is available in the app to recover eligible entitlements tied to the same store account.
We may use subscription infrastructure providers such as RevenueCat to validate purchases, restore purchases, and keep your Plus entitlement in sync with your InfinLume account.
We do not receive or store your full payment card number; payment details are handled by the applicable app store and its payment processors.
Prices may vary by region and currency, and may include taxes where applicable.
If a price changes, the applicable app store will notify you and, where required, obtain your consent before new pricing takes effect.
Refunds and billing disputes are handled by Apple App Store or Google Play according to their policies.
Nothing in these Terms limits any non-waivable consumer rights available under applicable law.

8. Free Trial and Introductory Offers

We may offer free trials or introductory pricing for eligible subscriptions. Eligibility is determined by Apple App Store or Google Play and may vary by account, region, and prior usage.

If a trial or introductory offer is provided and not canceled at least 24 hours before the offer period ends, the subscription converts to a paid subscription and renews automatically under Section 7.

Where permitted, offer access may be limited to one trial/introductory offer per account or per subscription offer.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

The Services will be uninterrupted, secure, or error-free
The results obtained from the Services will be accurate or reliable
Any defects in the Services will be corrected
The Services will meet your specific learning requirements or goals

InfinLume is an educational tool and does not guarantee fluency or any particular level of language proficiency.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INFINLUME AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless InfinLume and its officers, directors, employees, contractors, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

Your use of the Services
Your violation of these Terms
Your violation of any third-party rights
Any content you submit through the Services

12. Third-Party Services

The Services integrate with providers needed to operate InfinLume, including Google and Apple for authentication; Apple App Store and Google Play for purchases; RevenueCat for subscription management; Supabase for cloud backend services; Expo for notifications; and PostHog, Google Analytics, and Vercel Analytics for analytics or hosting.

Speech features may use Deepgram and Soniox for transcription. Certain open-ended speaking exercises may send the resulting transcript—but not the raw recording—to OpenAI or another configured text-evaluation provider such as DeepSeek. Categories of information, purposes, locations, training positions, and retention limits are described in our Privacy Policy.

Third-party services operate under their own terms and privacy policies. InfinLume remains responsible for explaining our processing and for selecting providers, but we do not control a third party’s independent website or service.

13. Termination

We may terminate or suspend your access to the Services immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination:

Your license to use the Services will immediately cease
Where applicable, you must delete all copies of the App from your devices
We may delete your account and associated data (subject to our Privacy Policy)

You may delete your InfinLume data in the app through Account Settings > Delete Account. This removes account-linked learning and speaking data, clears local app data, and signs you out. Limited purchase, entitlement, billing, security, fraud-prevention, accounting, legal, dispute, and communication-preference records may be retained as described in our Privacy Policy, including where needed to validate or restore paid access.

Deleting InfinLume data does not cancel an App Store or Google Play subscription and does not clear anonymous TCF practice saved only in browser local storage.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which InfinLume is incorporated, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Services shall be resolved through binding arbitration, except where prohibited by law. You agree to waive any right to a jury trial or to participate in a class action lawsuit.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the Services or on our website and updating the "Last Updated" date. Your continued use of the Services after changes are posted constitutes your acceptance of the modified Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and InfinLume regarding your use of the Services and supersede any prior agreements.
